Information on the processing of personal data of job candidates
Pursuant to Article 13 of Regulation (EU) 679/2016 and Legislative Decree 30 June 2003 n.196 as amended with Legislative Decree 10 August 2018, n.101 (Privacy Code)
P4Future S.r.l. (hereinafter also just “P4Future”), as Data Controller, informs you in accordance with the applicable national legislation and the European Privacy Regulation no. 679/2016 (“GDPR”) on the purposes and methods of processing your data.
1 – Why do we process your personal data?
The purpose of the processing of your personal data is to register your application for a job in our company and, if this application leads to the start of our selection procedure, to fill in your profile, meaning that P4Future S.r.l. will process all the data it deems necessary to evaluate your job application with a view to potential hiring. This evaluation may also involve an evaluation by a third party.
In case of a positive evaluation and a decision to hire you, we will use your personal data to prepare an employment contract.
If we decide not to hire you, we will retain your personal data for a certain period of time (see paragraph 6), so that we can contact you if future job opportunities match your profile.
2 – Which data do we process?
We collect and process your personal data, which includes all information relating to you and on the basis of which you can be identified. Anonymous data, which does not allow us to identify you, is therefore not considered personal data.
For the above purposes, the processing of personal data will include the following:
- Common data relating to your identity (surname, name, address, …);
- Personal Data (date and place of birth, nationality, gender, telephone number, e-mail address, hobbies and interests, …);
- Your photograph, if you voluntarily communicate it to us (for example it is included in your CV);
- Data relating to your professional experience (profile, data on previous employers, conclusions from previous jobs and activities carried out, special projects, …);
- Data relating to your education (diplomas, certificates, internships, …);
- Language skills; If applicable, if you hold a work and/or residence permit for one of the countries of the European Economic Area (EEA);
- Any other personal data that you communicate to us in the job application, in your CV or in the motivation letter, relating to the exercise of the role within P4Future S.r.l.;
- Any other personal data (than those mentioned above) that require processing under the law.
You are not required to provide us all this data. However, not providing them could negatively affect your hiring chances.
Any particular data that you may have spontaneously provided, or data suitable for revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, as well as data relating to health or sexual life or sexual orientation of the person, will not be processed in any way and will be deleted.
3 – On which legal basis do we process your data?
The processing of your data is necessary in order to take measures before entering into an employment contract and is therefore necessary for the execution of a contract of which you are a party or for the execution of pre-contractual measures adopted and requested by you.
4 – A chi comunichiamo i tuoi dati?
To carry out the activities necessary to achieve the purposes indicated above, P4Future may communicate your data to its employees, specifically authorized for processing by the Data Controller, or to collaborators or third parties, belonging to the following categories:
- employment intermediation agencies and subjects to whom the transfer of personal data is necessary or in any case functional to the management of applications by P4Future;
- subjects to whom the right to access personal data is recognized by provisions of the law, regulations, community legislation and collective bargaining;
- to professionals or service companies for business administration and management who operate on behalf of P4Future;
- professionals and consultants for the purposes of protecting the rights of P4Future.
The latter will use the data as “Data Controllers”, specifically appointed and instructed by P4Future as Data Controller, or as autonomous “Data Controllers” authorized to access them pursuant to legal provisions and regulations.
Your data will not be transferred to countries outside the European Economic Area.
5 – Will P4Future use automated decision-making processes?
Decisions relating to individuals which are based exclusively on automated data processing and which produce legal effects or similarly significantly affect the persons involved are defined as automated.
As a general rule, P4Future does not use automated procedures as described above. P4Future does not base its decision to hire you solely on the basis of automated processing of personal data.
6 – How long do we keep your data?
P4Future may retain your data only for the time necessary to carry out the processing for the purposes indicated above. In particular, the data provided will be kept for a maximum period of five years from the date of acquisition of your CV or, where the selection procedure activated has not resulted in an employment relationship, your personal data will be kept for a period maximum of five years from the conclusion of the same.
7 – Which are your rights?
Pursuant to the Regulation, in the manner and within the limits established by current legislation, you can exercise the following rights:
- Right of access – you have the right to obtain confirmation of the existence or not of processing concerning your data as well as the right to receive any information relating to the same processing.
- Right to rectification – you have the right to obtain rectification of your data if it is incomplete or inaccurate.
- Right to cancellation (so-called “right to be forgotten”) – in certain circumstances, you have the right to obtain the cancellation of your data present in our archives if they are not relevant for the continuation of the contractual relationship or necessary by legal obligation.
- Right to limit processing – upon the occurrence of certain conditions, you have the right to obtain the limitation of processing, if not relevant for the continuation of the contractual relationship or necessary by legal obligation.
- Right to portability – you have the right to obtain the transfer of your data to a different owner.
- Right to object – you have the right to object, at any time for reasons related to your particular situation, to the processing of data concerning you based on the condition of lawfulness of legitimate interest or the execution of a task of public interest or the exercise of public authorities, including profiling.
- Right to withdraw consent – you have the right to withdraw consent to the processing of your data at any time, without prejudice to the lawfulness of the processing based on consent before the revocation.
- Right to lodge a complaint with the Supervisory Authority – at any time, you have the right to promote requests for the exercise of your rights. In any case, if you wish to lodge a complaint regarding the methods through which your data are processed, or regarding the management of a complaint proposed by you, you have the right to submit a request directly to the competent supervisory authority in the Italian area (Personal Data Protection Authority) or to the one that carries out its tasks and exercises its powers in the Member State where the violation of the GDPR occurred.
